Do You Really Need a Prenup? What You Should Know Before (or After) Saying “I Do”

October 14, 2025
Marriage Rings on a Contract Being Signed
Marriage Rings on a Contract Being Signed

Let’s be honest: no one gets engaged dreaming about legal documents. When you’re planning a wedding, the last thing you want to think about is divorce. But here’s the truth — a prenuptial agreement isn’t about expecting the worst. It’s about protecting your future, setting clear expectations, and entering marriage with transparency and peace of mind.

At New England Law Group, our experienced prenuptial agreement attorneys help couples every week who want to start their next chapter on solid ground. Whether you’re marrying for the first time, bringing kids from a prior relationship, or entering with assets you’ve worked hard to build, a prenup (or postnup) can be one of the smartest decisions you make.

What Is a Prenup, Really?

A prenuptial agreement is a legal contract signed before marriage that outlines how finances, property, debts, and spousal support will be handled if the marriage ends in divorce or death.

A well-crafted prenup, prepared by an experienced prenuptial agreement attorney, can help protect:

  • Premarital assets
  • Family businesses
  • Future inheritances
  • Retirement savings
  • And even debt you don’t want to share

It can also clarify what counts as separate property vs. marital property and whether spousal support would be expected.

What If You’re Already Married?

Enter the postnuptial agreement — the often-overlooked sibling to the prenup. A postnup is similar but signed after you’re married. It can be useful if:

  • One spouse receives an inheritance
  • You’re starting a business
  • You’re experiencing marital stress and want clarity moving forward
  • You simply didn’t get around to signing a prenup

In Massachusetts, postnuptial agreements are reviewed with more scrutiny than prenups. That means it’s critical to work with an experienced postnuptial agreement attorney who knows how to draft a document that’s both legally enforceable and tailored to your goals.

Isn’t Asking for a Prenup… Unromantic?

Not at all. In fact, many couples say that working with a prenuptial agreement attorney to build a custom agreement brought them closer together. Think of it like estate planning. You’re not hoping something bad happens, you just want to be prepared.

Having a prenup can actually help prevent major disputes down the road by taking uncertainty off the table.

Do I Need One?

Not everyone needs a prenup or postnup—but many people benefit from having one. You might want to consider working with a prenuptial agreement attorney or postnuptial agreement attorney if:

  • You or your partner own a business or professional practice
  • You’re entering the marriage with significant savings or debt
  • This is a second marriage and you want to protect children from a prior relationship
  • You’re receiving family money or expect to inherit property
  • You simply want clarity and control over how things would be handled, just in case

We Can Help

At New England Law Group, we draft customized, enforceable prenuptial and postnuptial agreements that reflect your unique circumstances. Our prenuptial agreement attorneys and postnuptial agreement attorneys have years of experience guiding clients through this process with care, clarity, and discretion. No templates. No pressure. 5 Key Things to Include in a Prenuptial Agreement

Selective Focus of Wedding Rings Against Woman Hand Filing Divorce Papers or Premarital Agreement Prepared by Lawyer

At New England Law Group, we help couples draft strong, enforceable prenuptial agreements that provide peace of mind and legal clarity. Whether you’re marrying for the first time or entering a new chapter with significant assets, a well-crafted prenup is all about planning wisely — not pessimistically.

But what should actually go in your prenup? Here are five essential elements every prenuptial agreement should include:

1. Clear Identification of Separate Property

This is one of the main reasons people create a prenup — to protect assets they owned before marriage. That might include:

  • Real estate
  • Investment accounts
  • Retirement savings
  • Family heirlooms
  • A business or professional practice

Your prenup should spell out what property will remain yours, and what (if anything) will be shared if the marriage ends. This helps avoid disputes and confusion later.

2. How Marital Property Will Be Divided

Massachusetts law generally requires an “equitable distribution” of marital property in a divorce — which doesn’t always mean 50/50. A prenup can define in advance how property acquired during the marriage will be divided.

This is especially helpful if:

  • One spouse earns significantly more
  • One person plans to stay home to care for children
  • There are complex assets like real estate, a business, or a trust

3. Debt Allocation

Prenups can also protect you from becoming legally responsible for your spouse’s debt. This is a big one — especially if one partner is bringing student loans, business liabilities, or credit card debt into the marriage.

You can specify that each party remains responsible for their own pre-marital debts, or clarify how shared debt will be handled if the marriage ends.

4. Spousal Support/Alimony Terms

Your prenup can include terms about alimony — whether it will be waived entirely, capped at a certain amount, or structured in a specific way.

However, Massachusetts courts won’t enforce spousal support provisions that are “unconscionable” at the time of divorce, so it’s important to keep them fair and realistic. We’ll help you draft language that protects you — and holds up if challenged.

5. Sunset Clauses or Review Dates

You can include a “sunset clause” that automatically ends the agreement after a certain number of years, or include a provision that the prenup will be reviewed or renegotiated at a specific time. This can be helpful for couples who want protection early on but are open to revisiting terms after their financial lives become more intertwined.

What to Do After a Car Accident in Massachusetts: A Step-by-Step Guide

September 16, 2025

A car accident can be overwhelming, no matter how minor or major it may seem. In the chaos that follows, it’s easy to feel unsure about what steps to take to protect yourself, your rights, and your recovery. Whether you’re dealing with vehicle damage, injuries, or insurance concerns, knowing what to do immediately after a crash is crucial.

At New England Law Group, we provide trusted personal injury services across Massachusetts and throughout New England. Our experienced attorneys are committed to fighting for the compensation you deserve, so you can focus on your recovery while we handle the legal details. Call us today for a free consultation.

Step 1: Ensure Safety and Call 911

The first and most important step is making sure everyone is safe. If anyone is injured or if there’s any significant vehicle damage, you should call 911 immediately. Emergency responders will assess the situation, provide medical care, and file an official accident report, which will be vital for any insurance or legal claim later.

Tip: Even if the accident seems minor, it’s best to err on the side of caution and have the police document the scene.

Step 2: Move to a Safe Location

If your vehicle is drivable and you’re not seriously injured, move your car to the side of the road to avoid further danger. Turn on your hazard lights to alert other drivers and prevent additional accidents.

Step 3: Exchange Information

Once everyone is safe and emergency services are on the way (or have arrived), exchange information with the other driver(s). This includes:

  • Full name and contact information
  • Driver’s license number
  • License plate number
  • Insurance company and policy number
  • Make, model, and color of all vehicles involved

Important: Be polite but avoid admitting fault or making statements that could be used against you later.

Step 4: Document the Scene

Use your phone to take photos and videos of the accident scene, including:

  • Vehicle damage
  • Road conditions and signage
  • Skid marks or debris
  • Any visible injuries

This documentation can be critical for your insurance claim or if legal action becomes necessary.

Step 5: Seek Medical Attention

Even if you feel fine, it’s important to see a doctor as soon as possible after the accident. Some injuries, such as whiplash or internal trauma, may not show symptoms right away. Getting evaluated promptly also strengthens your legal and medical records in case you need to pursue compensation.

Step 6: Report the Accident

In Massachusetts, you must file a Motor Vehicle Crash Operator Report within five days if anyone was injured, there was over $1,000 in property damage, or a person was killed. You should also notify your insurance company of the accident as soon as possible.

Step 7: Contact a Personal Injury Attorney

Before talking to insurance adjusters or accepting any settlements, it’s in your best interest to speak with an experienced Massachusetts car accident lawyer. Insurance companies may try to minimize your compensation. At New England Law Group, we’ll help you understand your rights and guide you through the claims process every step of the way.

Brookline: Vision Zero in Action Amid Rising Crashes

September 2, 2025

Brookline has long been recognized for its forward-thinking approach to traffic safety. Through its commitment to the Vision Zero initiative, the town has pledged to eliminate all serious traffic injuries and fatalities. But despite those efforts, crash data reveals an ongoing risk to drivers, pedestrians, and cyclists alike.

Between 2019 and 2023, Brookline recorded more than 1,800 crashes—a sobering number for a community that has prioritized safe streets. These collisions resulted in over 350 injuries and 3 fatalities, according to official data from brooklinema.gov. That’s an average of nearly 360 crashes and 70+ injuries every year.

At New England Law Group, we applaud the goals of Vision Zero—but we also know that when crashes happen, real people are left dealing with serious pain, financial stress, and legal uncertainty. If you’ve been involved in an accident in Brookline, you’re not alone—and you may be entitled to compensation.

Crash Trends in Brookline: Route 9 Remains a High-Risk Corridor

Much of Brookline’s traffic volume moves along Route 9, also known as Boylston Street. According to the 2018 Route 9 Corridor Study from the Central Transportation Planning Staff (ctps.org), several intersections in Brookline pose known safety concerns:

  • Cypress Street
  • Sumner Road
  • Chestnut Hill Avenue
  • Labyrinth Road

While the crash rate along this corridor remains below the statewide average for urban roadways, that doesn’t mean it’s low. These intersections continue to generate a disproportionate number of collisions, particularly those involving rear-end or angle crashes—often during rush hour or in poor weather conditions.

What’s more, anecdotal feedback from Brookline residents highlights a growing perception that crossing busy intersections feels increasingly dangerous, particularly for seniors, children, and cyclists.

The Impact of Distracted Driving

One of the most concerning contributors to Brookline’s crash statistics is distracted driving. Statewide, Massachusetts recorded more than 17,000 distraction-related crashes between 2020 and 2024, with over 5,000 involving injuries. These are crashes that could often have been avoided—caused by drivers glancing at text messages, using GPS devices, or being momentarily distracted by in-car systems.

In densely populated areas like Brookline, even a moment’s lapse in attention can cause devastating harm. Busy pedestrian traffic, frequent stop-and-go conditions, and complicated intersections mean that drivers must remain vigilant at all times.

What Should Brookline Residents Do After a Crash?

Too often, victims of car crashes or pedestrian accidents in Brookline wait too long to seek help. Some hope the injuries will resolve on their own. Others don’t want to “make a big deal” of a collision—until the medical bills pile up or the insurance company starts playing games.

Delays can make it harder to prove your case, so it’s crucial to act quickly and thoughtfully. Here are steps you should take if you’ve been injured in an accident in Brookline:

  1. Get medical attention—even days later. Some injuries, such as whiplash or soft tissue damage, take time to fully manifest. Seeing a doctor not only helps you heal—it also documents your condition for the legal process.
  2. Save everything. Keep a folder with your medical bills, any insurance communications, photos from the crash scene, and receipts for out-of-pocket expenses like crutches, prescriptions, or Uber rides to doctor appointments.
  3. Track missed time from work. Lost wages are a key part of any personal injury claim. Even a few days out of the office due to pain or medical visits should be documented.
  4. Write down witness details. If anyone saw the crash happen, their statements could help your attorney establish fault.
  5. Request the police report. You can get this from the Brookline Police Department or the RMV, and it can offer critical insights into how the accident was recorded and who was cited.

How New England Law Group Builds Your Case

At New England Law Group, we take pride in understanding the unique traffic dynamics of each town we serve—including Brookline. When building your case, we go beyond just collecting basic documentation. We frame your injury within the context of Vision Zero and broader public safety efforts, which adds weight to your claim during insurance negotiations or in court.

Here’s how we help:

  • We investigate the crash scene, cross-referencing it with known collision data and traffic planning studies. If your accident happened at a high-risk location, that matters.
  • We gather surveillance or traffic cam footage whenever possible, especially near major intersections like those on Route 9.
  • We communicate directly with insurance adjusters, preventing them from pressuring you into a low settlement.
  • We calculate the full value of your claim, including future medical needs, lost income potential, and pain and suffering.
  • We prepare your case for trial, even if we aim to settle—because being ready for court puts pressure on the insurance company to settle fairly.

Our goal is simple: secure full compensation for your injuries while handling every aspect of the legal process so you can focus on recovery.

Brookline Deserves Safer Streets—And You Deserve Justice

The Vision Zero initiative is a step in the right direction. But until Brookline streets are truly free from serious crashes, there will always be victims left to pick up the pieces.

If you were injured in a car crash, pedestrian incident, or bike accident in Brookline—whether on Route 9, Harvard Street, Beacon Street, or elsewhere—you deserve legal representation that understands the local landscape.

Waltham: Under the Radar—but Crash Risk Is Real

August 19, 2025

Waltham may not be the first place that comes to mind when you think of dangerous driving conditions in Massachusetts—but the data tells a different story. While the city doesn’t always make headlines for traffic incidents, its roads are far from immune to serious and even fatal collisions.

At New England Law Group, we’ve seen firsthand how hidden hazards, high-traffic intersections, and distracted driving can dramatically change someone’s life in an instant. Whether you’re commuting along Lexington Street, heading toward Brandeis, or simply picking up dinner near Main Street, the risks are very real—and accident victims in Waltham deserve to be informed and protected.

The Reality of Crash Risk in Waltham

Though Waltham is often seen as a peaceful, suburban city, its crash history is sobering. According to publicly available city data, the city has recorded multiple fatal collisions nearly every year:

  • 3 fatal crashes in 2022
  • 1 in 2021
  • 2 in 2020
  • 2 in 2019

Many of these incidents involved pedestrians or bicyclists, highlighting the dangers that even those not behind the wheel can face.

One of the most concerning intersections is Lexington Street at Beaver Street, where traffic congestion, limited visibility, and pedestrian movement create a perfect storm. From 2009 to 2012, there was an average of 18 crashes annually at that intersection alone—and 27% of those resulted in injuries, according to the Boston Metropolitan Planning Organization.

Other High-Risk Areas and Contributing Factors

It’s not just one intersection. Daily crash logs from the Waltham Police Department consistently show incidents ranging from minor fender benders to more serious, injury-causing collisions on roads like:

  • Main Street
  • Moody Street
  • Route 20 (also known as Weston Street)
  • The I-95/128 corridor
  • Streets surrounding Brandeis University and Bentley University

With a dense student population, heavy foot traffic, and frequent congestion, these areas pose risks not only to drivers but also to cyclists and pedestrians.

Distracted Driving Is a Statewide Threat

Distraction-related crashes are also a statewide epidemic. Between 2020 and 2024, Massachusetts saw over 17,000 distracted driving crashes, according to the National Conference of State Legislatures. In busy towns like Waltham—especially around commercial areas and college campuses—even a few seconds of inattention can lead to devastating consequences.

What Crash Victims in Waltham Should Know

Many Waltham residents wait to call a lawyer after a car crash, hoping the insurance company will “handle everything.” Unfortunately, that delay can cost you—big time.

Valuable evidence like skid marks, surveillance footage, or witness memories can fade quickly. And if you don’t act fast, the insurance company may use that delay to downplay your injuries or reduce your payout.

Here’s what to do immediately after a car accident in Waltham:

  1. Seek medical attention, even if your injuries seem minor. What feels like a sore neck today could become a chronic injury tomorrow.
  2. Request the police report from the Waltham Police Department, the RMV, or online.
  3. Take photos of the crash scene, your vehicle, any visible injuries, and surrounding road conditions.
  4. Write down names and contact info of any witnesses.
  5. Track medical visits and time missed from work—this documentation is crucial when calculating your damages.

How New England Law Group Fights for Waltham Accident Victims

At New England Law Group, we go beyond surface-level claims. Our attorneys dig deep into police reports, crash reconstruction data, traffic studies, and insurance records to build a rock-solid case for our clients.

We routinely analyze:

  • Waltham crash report patterns
  • MPO traffic collision diagrams
  • Surveillance footage from businesses near intersections
  • Testimony from traffic engineers and medical professionals

Whether you’re dealing with broken bones, traumatic brain injuries, emotional distress, or the wrongful death of a loved one, we understand what you’re going through—and we’ll fight for every dollar you’re owed.

What Can You Be Compensated For?

If you’ve been injured in a car accident in Waltham, you may be eligible for compensation covering:

  • Medical expenses (emergency care, surgeries, physical therapy, medications)
  • Lost wages and future earning potential
  • Pain and suffering
  • Emotional distress or PTSD
  • Long-term rehabilitation and care costs
  • Property damage
  • Wrongful death compensation (for surviving family members)

The sooner you begin working with an attorney, the sooner we can begin calculating and building your claim.

Why We’re Proud to Serve Waltham

Waltham is a city rich in history, culture, and education. From the trails of Prospect Hill Park to the energy surrounding Moody Street’s restaurants and shops, it’s a place where residents deserve to feel safe—especially when crossing the street or driving through town.

We believe in helping Waltham residents reclaim their peace of mind after a crash. At New England Law Group, we don’t use billboards or TV commercials—we rely on results. And we’re proud of the trust Waltham clients place in us every day.

Dealing with Insurance Adjusters After a Car Accident in Massachusetts

August 5, 2025

If you’ve been in a car accident in Massachusetts, chances are you’ll hear from an insurance adjuster within hours—sometimes even before you’ve had a chance to process what happened. At first, they may seem helpful or even sympathetic. But make no mistake: insurance adjusters work for the insurance company, not for you.

At New England Law Group, we always tell our clients: be careful what you say—because what you say can and will be used to minimize your claim.

Whether the call comes from your own insurance company or the other driver’s insurer, it’s critical to understand their role in the process, the risks of talking too soon, and how to protect your legal rights from the start.

What Does an Insurance Adjuster Actually Do?

An insurance adjuster’s job is simple on paper: evaluate your claim and determine how much the insurance company should pay. But behind the scenes, there’s more to it. Their real mission is to save the company money by reducing, delaying, or denying your claim.

Here are some of the ways they do that:

  • Asking for recorded statements soon after the crash, when you may still be shaken or unsure of the details
  • Requesting access to your full medical history, not just records related to the accident
  • Scrutinizing damage estimates and offering low-ball valuations for vehicle repairs or total loss
  • Making early settlement offers that don’t come close to covering your long-term needs

They may seem friendly, patient, or even understanding—but remember: they are not on your side.

What You Should—and Shouldn’t—Say to an Insurance Adjuster

You are not legally required to give a recorded statement to the other driver’s insurance company—and in most cases, we recommend that you don’t. Even your own insurer may try to get you to say something that could hurt your case later.

Insurance adjusters are trained to ask questions that lead you to downplay your injuries or accept partial blame. Something as innocent as “I’m feeling better today” or “I might have looked down for a second” can be used against you.

Here are common mistakes that can harm your case:

  • Admitting partial fault: Saying things like “I might’ve been speeding” or “I didn’t see the other car”
  • Minimizing your injuries: Early on, adrenaline may mask symptoms. Saying “I’m okay” could be interpreted as having no injury.
  • Speculating about the crash: If you’re unsure, don’t guess. Even speculative statements can be twisted to shift liability.
  • Discussing pre-existing conditions without context: This could allow insurers to argue that your injury wasn’t caused by the crash.

Instead, politely decline to give a statement until you’ve consulted with a personal injury attorney. Your right to legal representation exists from day one—and using it is one of the smartest steps you can take.

Why You Should Be Wary of Fast Settlement Offers

One of the most common tactics used by insurance adjusters is the “quick offer”—a low settlement presented just days after the crash. These offers are often positioned as generous or “enough to take care of the basics,” and adjusters may encourage you to sign quickly so you can move on.

But here’s the catch:
Once you accept a settlement, you can’t go back for more—even if your injuries worsen, or you discover new complications.

Before you accept any offer, ask:

  • Have I completed my medical treatment or reached a clear diagnosis?
  • Have I accounted for long-term care, rehabilitation, or lost earning potential?
  • Does the settlement include compensation for pain and suffering?
Have I reviewed the offer with a qualified attorney?

Without legal guidance, it’s easy to undervalue your claim, especially if you’re focused on getting immediate financial relief. That’s exactly what the insurance company is hoping for.

How New England Law Group Can Help

At New England Law Group, we deal with insurance companies every single day—and we know how to stand up to them. From the moment you call us, we take the pressure off your shoulders and put a barrier between you and the adjusters.

Here’s what we do:

  • Handle all communications with insurance companies so you don’t have to
  • Gather and organize documentation, including police reports, medical records, proof of wage loss, and crash scene evidence
  • Review and respond to all settlement offers with your best interest in mind
  • Negotiate for maximum compensation—not just for your bills, but for your suffering, future needs, and lost potential
  • Prepare your case for trial if the insurer refuses to offer a fair settlement

We understand how overwhelming this process can feel—especially when you’re injured and trying to heal. That’s why we treat your case like it’s our own.

Don’t Let the Insurance Company Rush or Pressure You

You may only get one chance to recover compensation for your injuries. Don’t let an insurance adjuster rush you into a low settlement, confuse you with legal jargon, or make you feel like you have no other option.

We’ve helped hundreds of clients throughout Massachusetts recover fair settlements—even in cases where insurance companies initially denied or undervalued the claim.

The Other Driver Was at Fault—So Why Is My Insurance Paying?

July 22, 2025

We hear this all the time from our clients:
“The other driver hit me. Why is my insurance company paying the medical bills?”

It feels counterintuitive—and frustrating. After all, if you weren’t at fault for the crash, shouldn’t the other driver be responsible for the costs?

The short answer? That’s how it works in Massachusetts.
We’re a no-fault state, which means the insurance claims process operates a bit differently than in many other parts of the country.

Understanding No-Fault Insurance in Massachusetts

In Massachusetts, the law requires that your own auto insurance policy pay for your initial medical bills and lost wages after a car accident—no matter who caused the crash.

This coverage is called Personal Injury Protection, or PIP for short. Most auto insurance policies in the state automatically include PIP coverage, which typically pays:

  • Up to $8,000 for medical expenses and/or lost income
  • Regardless of who was at fault in the accident
  • Quickly and without needing to sue anyone

At first glance, this can feel backward—especially when the other driver clearly caused the crash. But the goal of the no-fault system is to ensure that accident victims get medical treatment right away, without having to wait for months or years for a legal case to resolve.

Why Massachusetts Uses the No-Fault System

Massachusetts law prioritizes fast access to care and aims to reduce the number of smaller claims that wind up in court. Here’s what the system is designed to do:

  • Avoid unnecessary lawsuits for minor injuries
  • Speed up access to medical treatment by removing the need to prove fault up front
  • Reduce strain on the court system by settling many claims directly through insurance companies

But while it may work smoothly for low-impact collisions or minor injuries, it can get a lot more complicated—and unfair—when you’re seriously hurt.

What If the Other Driver Was Clearly at Fault?

If another driver ran a red light, rear-ended you, or caused the crash through obvious negligence, you might assume their insurance company should be on the hook from day one. And ultimately, they may be—but not at first.

Even in clear liability cases, your insurance company pays first under your PIP coverage. Only after your PIP benefits are exhausted (up to $8,000) can you potentially file a bodily injury claim or lawsuit against the at-fault driver.

To do that, though, you must meet one of the following legal thresholds:

You may pursue a claim against the other driver’s insurance if:

  • Your medical expenses exceed $2,000, or
  • You suffered a serious injury, such as:
    • Broken bones
    • Permanent disfigurement or scarring
    • Loss of sight or hearing
    • Substantial loss of a bodily function

Once you meet these criteria, you can seek compensation for damages that PIP doesn’t cover, such as:

  • Pain and suffering
  • Future medical costs
  • Long-term care
  • Loss of enjoyment of life
  • Permanent disability
  • Loss of earning capacity

Will My Insurance Company Be Reimbursed?

Yes—and this is one part of the system that many people don’t realize.

When the other driver is found to be at fault, and you’ve filed a bodily injury claim or lawsuit, your insurance company will typically seek reimbursement from the at-fault party’s insurer for the PIP payments they made.

This process is called subrogation. In essence, your insurer pays you quickly so you can get treatment—and later recovers those funds from the responsible party’s insurer. Importantly:

  • You are not penalized for using your PIP coverage
  • Your insurance premium should not go up, since you weren’t at fault
  • There’s no surcharge, provided the other driver’s fault is established

This helps prevent you from being financially punished for something that wasn’t your fault.

Why Legal Representation Matters

While the no-fault system is intended to simplify things, it’s not always fair—and it’s definitely not simple when serious injuries or large expenses are involved.

Insurance companies (even your own) often try to:

  • Limit how much they pay for treatment
  • Push you to use specific doctors
  • Question whether your care was “reasonable and necessary”
  • Deny claims outright if documentation is incomplete or delayed

And when it’s time to pursue compensation beyond PIP, you can expect pushback from the other driver’s insurer, who will try to minimize or deny your claim entirely.

That’s where we come in.

At New England Law Group, we:

  • Review your PIP coverage and help you maximize benefits
  • Ensure your medical treatment is well-documented
  • Help you meet the legal threshold to pursue additional compensation
  • Negotiate with the at-fault driver’s insurance on your behalf
  • Fight for a full and fair settlement—or take your case to court if needed

You Don’t Have to Figure This Out Alone

The Massachusetts no-fault system can be confusing—even when it works the way it’s supposed to. If you’re injured in a car accident in Massachusetts and unsure why your insurance is paying, what you’re entitled to, or how to move forward, you’re not alone.

Let us answer your questions, evaluate your case, and help you pursue the full compensation you deserve.

How Much Is My Massachusetts Car Accident Case Worth?

July 8, 2025

One of the first questions we hear from clients after a car accident is, “How much is my case worth?”

It’s a fair question—and an important one. If you’re dealing with serious injuries, unable to work, and watching the bills pile up, you want to understand what kind of financial recovery you can expect. Unfortunately, there’s no one-size-fits-all answer. Every car accident case is unique, and its value depends on a combination of legal, medical, and financial factors.

That said, we can walk you through the key elements that determine how a car accident case is valued in Massachusetts—and how we at New England Law Group approach the process of getting you the compensation you deserve.

1. Your Injuries

The most significant factor in determining the value of your case is the nature and severity of your injuries. The law recognizes that more serious injuries generally result in greater losses—more medical bills, longer time away from work, and more pain and suffering.

Were you treated and released the same day with minor soreness or bruises? Or were you hospitalized, required surgery, and referred for months of physical therapy? Are you expected to recover fully, or will you have chronic pain or limited mobility for years to come?

We examine all of this by reviewing your:

  • Emergency room records
  • Follow-up care and treatment plan
  • Surgical and rehabilitation records
  • Future medical needs
  • Permanent disability or scarring

More serious injuries—like spinal damage, traumatic brain injuries, broken bones, or herniated discs—typically result in higher settlements or awards.

2. Lost Wages and Reduced Earning Capacity

If you missed work after the accident, those lost wages are part of your claim. But what many people don’t realize is that if your injury limits your future ability to work or forces you to take a lower-paying job, that lost potential income can also be included in your claim.

We help clients document not just the paychecks they missed, but also the impact their injuries have had on their career. This often involves working with employers, accountants, or even vocational experts to quantify your loss in a way the insurance company can’t ignore.

Examples include:

  • A construction worker who can no longer lift heavy materials
  • A nurse who developed chronic back pain and can no longer stand for long shifts
  • A self-employed person who lost clients due to downtime

3. Pain and Suffering

“Pain and suffering” isn’t just a legal term—it’s a very real consequence of a car crash. These non-economic damages reflect the physical pain, emotional distress, and reduced quality of life you experience after an accident.

While it’s not easy to assign a dollar value to these losses, Massachusetts law allows injured people to recover for pain and suffering if:

  • Their reasonable medical expenses exceed $2,000, or
  • They suffer certain injuries such as fractures, permanent disfigurement, or loss of a body part or function

We often support pain and suffering claims with:

  • Testimony about your day-to-day limitations
  • Medical expert reports
  • Psychological evaluations
  • Statements from family or caregivers

If your life has been turned upside down by your injuries, this part of your case deserves strong advocacy—and we’re here to provide it.

4. Who Was at Fault?

Massachusetts follows a comparative fault system. That means your compensation can be reduced if you’re found to be partially responsible for the accident. For example:

  • If you’re 10% at fault, your final award will be reduced by 10%.
  • If you’re 51% or more at fault, you’re not entitled to recover damages at all.

That’s why proving fault—and protecting your share of liability—is one of the most critical parts of your case. Our legal team will:

  • Analyze police and accident reports
  • Review traffic camera or dashcam footage
  • Interview witnesses
  • Bring in accident reconstruction experts when necessary

We fight hard to ensure the other party is held accountable, and that you’re not unfairly blamed for something that wasn’t your fault.

5. Insurance Coverage

In some cases, the biggest limitation on your compensation isn’t the strength of your case—it’s the available insurance coverage.

Massachusetts law requires drivers to carry minimum liability coverage, but many policies don’t go far enough to cover serious injury claims. If the at-fault driver only has $20,000 in coverage, and your losses exceed that amount, you may need to turn to your own underinsured motorist coverage—or explore other sources of recovery.

At New England Law Group, we leave no stone unturned. We investigate all potentially liable parties and policies, including:

  • Multiple vehicle owners
  • Commercial insurance (if the at-fault driver was working)
  • Umbrella policies
  • Municipal or state liability (in the case of unsafe roads or government vehicles)

There’s No Magic Calculator—But There Is a Smart Strategy

Despite what you might find in online “settlement calculators,” there’s no precise formula that will tell you exactly what your case is worth. Every accident is different, and outcomes vary depending on negotiation skill, documentation quality, and even the insurance company’s approach.

What we can promise is this:

  • We will give you an honest, experience-based assessment of your claim.
  • We will document every aspect of your losses thoroughly and strategically.
  • We won’t pressure you into a quick settlement just to close your file.
  • We will negotiate aggressively and take your case to court if necessary.

Newton: Confronting Crash Risk on Route 9 and Beyond

June 24, 2025

Newton is a beautiful, historic city filled with vibrant neighborhoods, prestigious schools, and thriving commercial areas. But for all its charm, Newton’s roadways—especially Route 9—have become increasingly hazardous for both drivers and pedestrians.

At New England Law Group, we closely monitor crash data, and recent reports from the Massachusetts Department of Transportation highlight a troubling trend. Route 9 through the Chestnut Hill area has emerged as a particular hotspot for accidents, with high traffic volume and limited pedestrian infrastructure compounding the risks.

In March 2025, tragedy struck when a pedestrian was fatally hit near The Shops at Chestnut Hill—a stark reminder of how dangerous this stretch of road can be. That intersection, which sees heavy vehicle and foot traffic, has since prompted public discussions about the urgent need for improved crosswalk visibility, traffic calming measures, and better lighting.

Crash Trends in Newton: What the Data Tells Us

Our review of Newton Police Department crash dashboards confirms what many residents already feel: local roads have become riskier. Weekday rush hours—particularly along Route 9, Chestnut Hill Avenue, Centre Street, and Beacon Street—see a spike in both injury-related and property-damage crashes.

Several factors contribute to this:

  • High commuter volume traveling to and from Boston and nearby suburbs
  • Confusing intersections, especially where local and regional traffic converge
  • Aging infrastructure in certain areas, leading to limited visibility and road hazards
  • Mixed-use zones where pedestrians, cyclists, and vehicles share tight spaces

While these structural and environmental factors play a role, driver behavior is still the leading cause of most accidents.

Distracted Driving: A Growing Concern

Distracted driving continues to be a top contributor to crashes in Newton. Whether it’s texting at a red light, following GPS directions, adjusting music, or simply taking a moment to look away from the road—these seemingly minor distractions can result in major accidents.

In Newton’s high-density areas like Chestnut Hill, Nonantum, and Newton Centre, even a split second of inattention can put pedestrians, cyclists, and other drivers in danger. At New England Law Group, we’ve handled numerous cases where distracted driving was a central factor, and we understand how to uncover and present the evidence needed to hold negligent drivers accountable.

What This Means for You

If you or a loved one has been injured in a motor vehicle accident in Newton—whether on Route 9, Chestnut Hill Avenue, or another busy street—it’s critical to act quickly. Even if the other driver admits fault at the scene, insurance companies may still dispute your claim or downplay the extent of your injuries.

Here’s what to do:

1. Seek Medical Treatment Immediately

Even if your injuries feel minor, symptoms like whiplash, soft tissue damage, or concussions can take hours or days to appear. Documenting them early is crucial to both your health and your case.

2. Gather Evidence

Take photos of the crash scene, your vehicle, visible injuries, and the surrounding area. If possible, obtain witness statements and request access to surveillance or traffic cam footage.

3. Don’t Go It Alone

The legal process can be overwhelming, especially when you’re trying to recover physically and emotionally. At New England Law Group, we handle every aspect of your case—from requesting Newton Police reports to reviewing medical records, insurance policies, and traffic data.

Understanding the Role of a Car Accident Lawyer

Being involved in a car accident can be a traumatic and life-changing experience. Medical bills, missed work, insurance disputes, and physical recovery can all add up quickly. That’s where a car accident lawyer comes in. Their primary role is to advocate for victims and help them recover financially, emotionally, and physically from their injuries.

Here’s a closer look at what a car accident lawyer does:

1. Investigates the Accident

Your lawyer will gather crucial evidence to build a strong case. This includes:

  • Police reports
  • Medical records
  • Eyewitness statements
  • Photos and video footage
  • Accident reconstruction, if necessary

They may also work with medical professionals and accident reconstruction experts to determine liability and the extent of your injuries.

2. Communicates with Insurance Companies

Insurance companies often aim to minimize payouts. A skilled car accident lawyer handles all communication with insurers to:

  • Protect you from lowball offers
  • Avoid statements that could hurt your case
  • Negotiate a fair settlement on your behalf

Lawyers understand the tactics insurers use and can push back with solid evidence and legal strategy. This not only helps you secure the compensation you deserve but also takes the stress of constant negotiation off your shoulders.

3. Calculates the True Value of Your Claim

It’s not just about your medical bills. A lawyer will consider:

  • Future medical treatment
  • Lost wages and earning potential
  • Pain and suffering
  • Emotional distress
  • Property damage

They ensure that you’re compensated for both current and future losses.

4. Negotiates Settlements

Most car accident cases are settled out of court. A lawyer uses the gathered evidence and their negotiation skills to push for the maximum settlement possible without a trial. This can save you significant time, money, and emotional stress compared to going through a lengthy court process. Plus, when insurance companies see that you have strong legal representation, they’re often more willing to make a serious offer upfront.

5. Represents You in Court

If a fair settlement can’t be reached, your lawyer will take the case to court and represent you through every phase of litigation, from filing the lawsuit to presenting evidence at trial. They’ll prepare legal arguments, question witnesses, and challenge the opposing side’s claims to strengthen your position. Having an experienced trial attorney can make a significant difference in how your case is decided and in the compensation you ultimately receive.
