Newton Dog Bite Case: Runner Seriously Injured Near the Newton Free Library

January 8, 2026
A dog stands on a sidewalk. It is a brown-coated dog wearing a collar and leash.

At New England Law Group, our dog bite attorneys represent clients whose lives are suddenly disrupted by preventable injuries. This case involved “Lisa,” a lifelong runner who had lived in Newton for years and regularly ran the same familiar route near the Newton Free Library along Commonwealth Avenue.

On a bright spring morning, her routine run took a devastating turn.

An Unprovoked Dog Attack on Commonwealth Avenue

As Lisa passed a driveway, a terrier mix suddenly ran loose from the yard and charged her. Without any provocation, the dog chased her down the sidewalk.

She tried to outrun it, adrenaline kicking in, but the dog was faster. It bit her multiple times on the leg, including a deep bite that tore into her Achilles tendon.

The pain was immediate and overwhelming.

Serious Physical Injuries and Emotional Trauma

Lisa collapsed to the ground, twisting her arm and shoulder as she fell. She lay injured, bleeding, and terrified until a passerby stopped to help and called for emergency medical care.

The attack caused severe physical injuries, but the emotional impact was just as significant. What had once been a peaceful daily run became a source of fear and anxiety.

Proving Responsibility Under Massachusetts Dog Bite Law

In the aftermath, the dog’s owner attempted to avoid responsibility, initially claiming they did not own the dog and suggesting it may have belonged to someone else.

We conducted a thorough investigation.

By obtaining records from the City of Newton Animal Control, we confirmed that the dog was registered to the property and that the individual we identified was listed as the official keeper. The evidence was clear—the dog was theirs, and it had not been properly restrained.

Under Massachusetts General Laws Chapter 140, Section 155, dog owners are strictly liable for injuries caused by their dogs when the victim is lawfully in a public place, as Lisa was.

A Long and Difficult Road to Recovery

Lisa required surgery to repair the damage to her Achilles tendon, followed by months of physical therapy for both her leg and shoulder. Walking was difficult. Running—the activity that defined so much of her identity—was impossible for a long time.

In addition to physical rehabilitation, she experienced anxiety, sleep disruption, and a fear of dogs she had never known before.

This case highlights an important truth: dog bite injuries are not just surface wounds. They can permanently affect a person’s body, confidence, and emotional well-being.

Securing a Full Settlement for a Dog Bite Victim

With clear evidence and persistent legal pressure, the dog owner’s homeowner’s insurance company ultimately paid the full claim. The settlement covered:

  • Emergency room and surgical care
  • Physical therapy and rehabilitation
  • Psychological counseling
  • Lost income from missed work
  • Pain and suffering
  • Permanent scarring and future care

The result was about more than compensation. It was about accountability and giving Lisa the closure she needed to move forward.

Why This Newton Dog Bite Case Matters

This case reinforces several key principles of Massachusetts dog bite law:

  • Dog owners are responsible—even if the dog has never bitten before
  • Victims have the right to full compensation
  • Insurance companies are not the final word
  • You do not have to face the process alone

Dog attacks can happen anywhere—on quiet sidewalks, during daily routines, and in neighborhoods that feel safe.
