Wills and Trusts serve as foundational elements in any estate plan. Without them, your estate may be subject to lengthy and costly probate processes. A well-drafted Will or Trust ensures that your assets go to your loved ones according to your wishes. It also provides peace of mind knowing that your affairs are handled as you see fit.

Wills outline your desires for the distribution of your property after death. A Trust, on the other hand, can manage and distribute your assets during your life and after your death, often avoiding probate and providing greater privacy.

At New England Law Group, our estate planning attorneys know that no two families are the same. That’s why we offer personalized legal solutions tailored to your unique needs.

There are several types of wills to consider, depending on your specific needs:

Simple Will

A simple Will is a straightforward document that outlines how your estate will be divided upon your death. It is ideal for individuals with uncomplicated estates and can be a cost efficient way to protect your assets and your family.

Testamentary Trust Will

This type of Will creates a Trust at the time of passing. It allows you to distribute assets to beneficiaries in a controlled manner, which can be especially beneficial if you have minor children or wish to delay the distribution of assets to certain family members.

Pour-Over Will

A pour-over Will works with a living trust. It directs any remaining assets at your death into a Trust, ensuring that all your estate is managed under the terms of the trust.

Durable Power of Attorney

Durable Power of Attorney (DPA) is a legal document that allows you to appoint someone to make financial or healthcare decisions on your behalf if you become incapacitated or unable to make those decisions yourself. Unlike a standard power of attorney, a durable power of attorney remains effective even if you lose the ability to manage your affairs due to illness or injury. Having a DPA in place ensures that your financial, legal, and healthcare matters are handled according to your wishes when you’re unable to do so.

Healthcare Proxy

A Healthcare Proxy is a legal document that allows you to designate someone you trust to make medical decisions on your behalf if you become unable to communicate or make decisions due to illness or injury. This person, known as your healthcare agent, will have the authority to ensure that your medical care aligns with your preferences when you’re unable to express them yourself. A healthcare proxy is an essential part of planning for your future healthcare needs.

Trusts are powerful estate planning tools that can provide greater control, privacy, and flexibility than a simple Will alone. Here are the most common types:

Revocable Living Trust

This type of trust allows you to transfer ownership of your assets into the Trust, which is managed by a Trustee during your lifetime. As the Grantor, you can change or revoke the trust at any time. It helps you avoid probate and ensures your assets are distributed without delay upon your death.

Irrevocable Trust

Unlike a Revocable Trust, an Irrevocable Trust cannot be changed or revoked once it’s established. This makes it ideal for individuals looking to reduce their taxable estate or protect assets from creditors. It’s also commonly used to plan for Long Term Care and/or Medicare or Medicaid eligibility.

Special Needs Trust

A special needs Trust provides for the care of a beneficiary with disabilities. It ensures that the beneficiary can still receive government benefits while also benefiting from additional assets placed in the trust.

Charitable Trust

A Charitable Trust allows you to donate assets to a charitable organization while also benefiting from tax deductions. You can direct how and when your assets are distributed to the charity.

Spendthrift Trust

This type of Trust is designed to protect the beneficiary from creditors. It limits the beneficiary’s access to the Trust’s assets, thus ensuring they can’t squander the inheritance or face financial risks.

A simple Will or Trust can avoid huge hassle and expensive probate delays; and it does not need to cost a fortune! New England Law Group provides easy and transparent flat fee options.
